President Obama vetoes iPhone sales ban, Samsung disappointed

The administration of the US President Barack Obama has recently issued a veto on the pending sales ban of certain older Apple products (the iPad 2 or earlier and the iPhone 4 or earlier). Following a ruling of the US International Trade Commission (ITC) back in early June, the products were supposed to be banned from selling because of violation of a certain Samsung-owned standards-essential patent.

The Obama administration stepped up and disproved the ITC determination to issue an exclusion order and cease and desist order due to its effect on "competitive conditions in the U.S. economy and the effect on U.S. consumers." This action is entirely in the competence of the President's office although this block of the ITC ban is said to be the first of its kind since the Reagan administration in 1987.

Obama's office reminds of "the potential harms that can result" from using standards?-essential patents for "gaining undue leverage and engaging in ?patent hold?up". It reminds that standards?-essential patents should be easily accessible for licensing under FRAND terms, which, they consider, was not the case with this Samsung's patent.

Back in June, the ITC ruled that Apple was violating one of Samsung?s smartphone and tablet-related patents. Due to that decision, Apple was about to face bans on the sales of certain AT&T iPhone and iPad models. Apple was highly disappointed because they claimed Samsung would readily license the said patent to anyone else interested, yet it insisted on a sales ban in Apple's case.

Companies holding standards?-essential patent such as the one in question, are obliged to license these to third parties on terms that are Fair, Reasonable, And Non?Discriminatory (hence FRAND). According to Apple, in this case Samsung was far from offering them FRAND licensing terms.

Up until now Apple was appealing the ITC's initial ruling and the Commission was supposed to come up with a final ruling on August 9.

Fortunately, the block does not mean the patent holder is not entitled to a compensation, just on the contrary.

Samsung has already responded to the decision of the president's office:

?We are disappointed that the U.S. Trade Representative has decided to set aside the exclusion order issued by the U.S. International Trade Commission (ITC). The ITC?s decision correctly recognized that Samsung has been negotiating in good faith and that Apple remains unwilling to take a license.?

Quite expectedly, Apple's stance on the President's office decision is just on the contrary:

We applaud the Administration for standing up for innovation in this landmark case. Samsung was wrong to abuse the patent system in this way.

We are yet to see which direction this thing takes. It's more than obvious that the Apple vs. Samsung patent brawls are already getting out of hand. It's getting increasingly harder to tell who's right and who's wrong.

Oil leaks into Daytona canal

? After oil was discovered leaking into a canal west of Nova Road, officials determined the source was a hydraulic pump in a construction zone on Embry-Riddle Aeronautical University?s campus, an official said Thursday night.

Daytona Beach fire crews and the Volusia County Hazardous Materials team responded to the area of Museum and South Seneca boulevards when a ?steady flow of oil? was seen leaking into the canal adjacent to the intersection shortly after 7 p.m., Daytona fire spokesman Lt. Larry Stoney said in a release. The oil spill is not affecting any local water sources.

HazMat team members set up floatable booms to keep the oil from continuing into the canal system, Stoney said. No signs have contamination have been found in the interconnected canals.

Iraq war vet-turned NFL cheerleader arrested for alleged assault on video

PHOENIX -- An Arizona Cardinals cheerleader who made national headlines for her service in Iraq was recently arrested for allegedly assaulting her boyfriend and 3TV has exclusive video of the incident.

Megan Welter has been a Cardinals cheerleader for two years.

On July 20, she was arrested for alleged assault, disorderly conduct and criminal damage.

According to Scottsdale police, Welter and her boyfriend had been drinking excessively when they got into an argument that turned physical. Welter's boyfriend recorded video of the incident with his cell phone.

In the video, Welter can be heard asking "Who is she?" and repeatedly demanding her boyfriend give her his phone.

Welter reportedly told officers her boyfriend attacked her first, pushing her and even choking her. According to the police report, however, there were no marks on her -- no bumps or bruises, no signs that she had been? hit or strangled as she claimed.

When Welter called 911, she told the operator that her boyfriend was a "professional fighter" and had "smashed [her] head into tile" and had put her in what she described as a "choke hold with his legs."

Welter said she did not need paramedics.

"I just want him out of my house," she said.

It's unclear if there is a history of violence between Welter and her boyfriend, but we do know she does not have a criminal history.

Welter's boyfriend declined to talk to 3TV on camera, but he did release the following statement:

"People make mistakes, no one is perfect. I honestly want the best for her and I hope that this doesn't take away from the good things that she has done for both the NFL, as well as the service to our country. People seem to only remember the bad and it is easy to point fingers while standing on the outside. Now with that said, violence is never the answer and I honestly hope that this can be a learning experience for her and everyone else."

3TV reached out to the Cardinals organization Wednesday afternoon, but has yet to receive a response.

Welter received national attention earlier this week after sharing her story of transitioning from Iraq veteran to NFL cheerleader. An Army lieutenant and third-generation soldier, Welter entered Officer Training School after college in 2007. She served a 16-month tour in Iraq.

Police: Explosion on FedEx in San Francisco, California, caused by package containing fireworks - @KTVU

San Francisco police and firefighters responded to a report of an explosion involving a FedEx truck in the city's South of Market neighborhood Wednesday afternoon but didn't find any damage.

There was also no one injured in the incident, which was reported at 2:01 p.m. near Sixth and Tehama streets, fire department spokeswoman Mindy Talmadge said.

Police spokeswoman Officer Tracy Turner said the FedEx driver called 911 to report an explosion.

When officers arrived, however, they could not find any sign that an explosion had occurred, Turner said.

A bomb squad responded and Tehama and Sixth streets were shut down, but the streets reopened about an hour later.

The FedEx truck appeared to be intact, and the driver declined to speak with reporters at the scene.

Turner said it is possible that someone threw a firecracker in the area of the truck.

Michael McKinney, a security guard who works on that block of Tehama Street, said there was a similar incident on Monday involving a report of an explosion with no damage.

He said he heard a loud bang that day, and wondered if someone had thrown some sort of explosive object from a window.?

Talmadge said initial reports indicated that the explosion might have been caused by a package in the truck containing fireworks, but Turner said police determined that was not the case.

Obama has 'long list' of Fed candidates: Senate's Reid

WASHINGTON (Reuters) - President Barack Obama told U.S. Senate Democrats that he has a "long list" of potential candidates to take over as Federal Reserve Board chairman next year, and his party will support any of them.

Reid, speaking to reporters, said that while he believes former top White House economic adviser Lawrence Summers is a "very competent man," some other Democrats have raised concerns about him.

Obama "has a long list of people he's talking to. He indicated that there's not - his words - 'not a piece of paper difference in all of them,' so he's weighing all of the minuses and pluses and he's going to make a decision that he believes is right for the country and I do too," Reid said.
